General Conditions of Contract
The Council will always contract under its own
Conditions.
With regard to construction related projects, Terms and
Conditions of Contract are those contained within the standard
forms for the industry, information on ordering and hard copies of
which can be obtained as follows:
For work of a Building nature including JCT Contracts:
http://www.ribabookshops.com/
or www.ricsbooks.com/contracts.
For work of a Civil Engineering nature including ICE and NEC
Contracts:
http://www.ttbooks.co.uk/
Any amendments to be included by TDC to such standard forms are
specified within contract documentation on a project specific
basis.
Terms and Conditions to
be found on the back of a purchase order are also available on this
website.
The following General Conditions are intended as an
example of conditions of contract for
services, rather than contracts for
goods and/or works. These
general conditions of contract do not constitute a contract in
themselves. They will form part of a legally binding
agreement, along with various other documents. Each Contract
will cover the services, price, timetable etc.
The Council's ITT (Invitation to Tender) will cover tendering processes (including Form of
Tender and Collusion Certificate), the requirement for the
successful tenderer to execute a suitable form of agreement and any
Thanet District Council requirement for a performance bond.
The date of the formal legal agreement will be the Effective Date
for the purposes of the conditions.
