49. Entire Agreement

49.1   

The Contractor irrevocably and unconditionally waives, in the absence of fraud,

any rights which it might otherwise have had to seek to rescind or terminate this Contract or to claim damages against the Council or any of its officers, employees, advisers or agents for, or arising out of, any representation or breach of any warranty not contained in the Contract.
