Article 4 (2) Direction - Ramsgate & Pegwell Conservation Areas

The preservation of our history and heritage is an important social and cultural asset to Thanet. Its maintenance and protection also plays a role in the Districts economy.

 

There are areas which the Council and local community consider should be conserved and enhanced due to their special architectural or historic interest. The council has identified 20 such areas and designated them as conservation areas.

 

In order to help, protect and enhance these areas Thanet District Council has introduced new restrictions in the form of Article 4 (2) Direction within conservation areas, which will remove some rights to carry out alterations to certain properties within part of the Ramsgate and Pegwell Conservation Areas. Planning permission will now be required for these works, however no fee would be payable in this case.

A copy of the Direction is shown below. It sets out the details of the works which now require permission. However, this is not intended to prevent all change, it just allows the Council to consider more carefully the way building alterations are carried out.

The Direction

TOWN AND COUNTRY PLANNING ACT 1990

 

TOWN AND COUNTRY PLANNING (GENERAL PERMITTED DEVELOPMENT) ORDER 1995

 

Notice of making of a Direction under article 4(2) of the Town and Country Planning (General Permitted Development) Order 1995

 

NOTICE IS HEREBY GIVEN that Thanet District Council (“the Authority”) has made a Direction under article 4(2) of the Town and Country Planning (General Permitted Development) Order 1995 (“the Direction”).

 

The Direction applies to development of the type specified in the First Schedule to this Notice within the area described in the Second Schedule to this Notice.

 

The effect of the Direction is that permission granted by article 3 of the Town and Country Planning (General Permitted Development Order) 1995 shall not apply to development of the type specified in the First Schedule to this Notice and that such development shall not be carried out within the area specified in the Second Schedule to this Notice unless planning permission is granted by the Authority on an application made to the Authority under Part III of the Town and Country Planning Act 1990.

 

A copy of the Direction and of the map defining the area of land covered by it may be seen at the Planning Department, Thanet Gateway Plus, Cecil Street, Margate, Kent CT9 1RE (Open 9am-6pm Mon-Fri excluding Thurs 9am-8pm Sat 9am-5pm).

 

The Direction was made by the Authority on 18th December 2007 and comes into force in relation to the area specified in the Second Schedule to this Notice on the date on which this Notice is first published.  However, the Direction will expire on 18th June 2008 unless it is confirmed by the Authority before that date, having taken into account of any representations received within 28 days of 1st February 2008.

FIRST SCHEDULE

 

The Town and Country Planning (General Permitted Development) Order 1995

 

SCHEDULE 2  PART 1

 

DEVELOPMENT WITHIN THE CURTILAGE OF A DWELLINGHOUSE

 

Class A

The enlargement, improvement or other alteration of a dwellinghouse, where any part of the enlargement, improvement or alteration would front a relevant location.

 

Class C

Any alteration to the roof of a dwellinghouse, where the alteration would be to a roof slope which fronts a relevant location.

 

Class D

The erection or construction of a porch outside any external door of a dwellinghouse, enlargement, improvement or other alteration to the external door in question of a dwelling house that fronts a relevant location.

 

Class E

The provision within the curtilage of a dwelling house of any building or enclosure, swimming or other pool required for a purpose incidental to the enjoyment of the dwellinghouse as such, or the maintenance, improvement or other alteration of such a building or enclosure, that in either case where the building or enclosure, swimming or other pool to be provided would front a relevant location, or where the part of the building or enclosure maintained, improved or altered would front a relevant location.

 

Class F

The provision within the curtilage of a dwellinghouse of a hard surface for any purpose incidental to the enjoyment of the dwellinghouse as such, where the hard surface would front a relevant location.

 

SCHEDULE 2  PART 2

 

MINOR OPERATIONS

 

Class A

The erection, construction, maintenance, improvement or alteration of a gate, fence, wall or other means of enclosure, where the gate, fence, wall or other means of enclosure would be within the curtilage of a dwellinghouse and would front a relevant location.

 

Class C

The painting of the exterior of any building or work, where the painting of the exterior of any part of – a dwellinghouse; or

any building or enclosure within the curtilage of a dwellinghouse fronts a relevant location.

 

SCHEDULE 2,  PART 31

 

DEMOLITION OF BUILDINGS

 

Class B

Any building operation consisting of the demolition of the whole or any part of any gate, fence, wall or other means of enclosure, where the gate, fence, wall or other means of enclosure is within the curtilage of a dwellinghouse and fronts a relevant location.

 

A “relevant location” means a highway, waterway or open space
