Joint to Sole Tenancy
Guidance on how to change your council tenancy from joint to sole
Application for joint to sole tenancy
Use our online form to change your tenancy from joint to sole, where both tenants agree.
Please ensure you have read the guidance on this page before starting the form.
If you are currently in a joint tenancy and wish to transfer the agreement to a single person, it is important to understand the legal and financial implications. Please review the following conditions regarding your rights and responsibilities before proceeding:
- To change from a joint to a sole tenancy, both tenants must agree to this.
- Once the tenancy is in a sole name, that person will be solely responsible for all parts of the tenancy.
- They will be responsible for paying the rent and any service charges or any under-occupation charges.
- You won’t be able to add anybody else to the tenancy.
- There are no further rights of succession and no one will be able to succeed to the tenancy in future.
- Submitting this form does not change the tenancy. The tenancy remains a joint tenancy and both tenants remain jointly liable for all aspects of the tenancy (including rent payments) until the change is confirmed by Thanet District Council.
If one joint tenant dies, the remaining tenant automatically becomes the sole tenant. Please use our online form to let us know of the death of a tenant in a Thanet District Council property.
